2. Purpose
This Legal Notice governs access to, browsing of, and use of the website mawplugins.com (the “Site”), owned by Mondays at Work S.L. (“MAW Plugins”, “we”, “us”).
MAW Plugins develops and sells premium plugins for WordPress and WooCommerce, aimed at agencies and professionals in the sector.
Browsing the Site and accessing any of its content grants you the status of user (the “User”) and implies full acceptance of all conditions included in this Legal Notice, our Privacy Policy, our Cookie Policy, and the Site’s Terms of Service.
3. Conditions of access and use
Access to the Site is free of charge, except in relation to the purchase of the products and services offered, whose specific terms are set out in the Terms of Service and the applicable Software License Agreement.
The User agrees to make appropriate and lawful use of the Site, in accordance with applicable law, this Legal Notice, generally accepted morality and good practice, and public order. Among other things, the User shall not:
- Engage in unlawful, illegal activities, or activities contrary to good faith and public order
- Disseminate content or propaganda of a racist, xenophobic, illegally pornographic nature, in support of terrorism, or that violates human rights
- Cause damage to the physical or logical systems of MAW Plugins, its suppliers, or third parties
- Introduce or spread computer viruses or any other physical or logical system capable of causing damage
- Attempt to access, use, and/or manipulate data belonging to MAW Plugins, third-party providers, or other users without authorisation
- Reproduce, copy, distribute, transform, or modify the licensed software outside the terms expressly authorised in the Software License Agreement
4. Intellectual and industrial property
All content on the Site — including, without limitation, text, photographs, graphics, images, icons, technology, software, links, as well as the graphic design and source code — is the property of MAW Plugins or, where applicable, is used under licence or express authorisation from its authors. All rights reserved.
Under Articles 8 and 32.1, second paragraph, of Spain’s Intellectual Property Law, the reproduction, distribution, and public communication — including making available — of the whole or part of the content of this Site for commercial purposes, in any medium and by any technical means, is expressly prohibited without the authorisation of MAW Plugins.
The specific terms and conditions governing use of the software licensed by MAW Plugins are set out in the Software License Agreement, available at mawplugins.com/license-agreement/.
“MAW Plugins” and “Mondays at Work” are trademarks, registered or pending registration, owned by Mondays at Work S.L.
5. Disclaimer of warranties and liability
MAW Plugins shall not, under any circumstances, be liable for any damages of any nature arising from:
- The unavailability, lack of maintenance, or ineffective operation of the Site or its services
- The presence of viruses, malware, or other harmful programs in the content
- Unlawful, negligent, fraudulent use, or use contrary to this Legal Notice
- The lack of lawfulness, quality, reliability, usefulness, and availability of services provided by third parties and made available to users on the Site
Specific warranty terms and limitation of liability provisions regarding the licensed software are set out in the Software License Agreement (Sections 9 and 10).
6. Links
Where the Site provides links or hyperlinks to other websites, MAW Plugins exercises no control whatsoever over such sites and their content. Under no circumstances shall MAW Plugins assume any liability for the content of a link belonging to a third-party website.
7. Data protection
The processing of personal data collected through the Site is governed by our Privacy Policy, available at mawplugins.com/privacy-policy/, in compliance with the General Data Protection Regulation (GDPR, Regulation (EU) 2016/679) and Spain’s Organic Law 3/2018 of 5 December on the Protection of Personal Data and the Guarantee of Digital Rights (LOPDGDD).
8. Governing law and jurisdiction
These terms are governed by Spanish law. For the resolution of any dispute arising from access to or use of the Site, the parties submit to the Courts and Tribunals of Madrid, Spain, unless consumer protection law establishes a different, non-waivable forum for the User, in which case that law shall apply.
